GENERAL WORKMANSHIP GUARANTEE

This General Workmanship Guarantee is provided by Peachey Contracting (the “Contractor”) to the property owner (the “Owner”) for work performed under the applicable contract or agreement.

GUARANTEE

The Contractor guarantees that all work performed will be completed in a professional and workmanlike manner, consistent with generally accepted construction standards and applicable building codes.

The Contractor agrees to repair or correct any defects in workmanship that arise from improper installation or performance of the work for a period of five (5) year from the date of project completion, unless otherwise specified in writing.

If a defect in workmanship is discovered during the guarantee period, the Contractor will, at its sole option, repair or replace the defective portion of the work at no cost to the Owner, provided the defect falls within the terms of this guarantee.

Repairs will be scheduled and completed within a reasonable timeframe after the Contractor has been notified.

OWNER RESPONSIBILITIES

The Owner must notify the Contractor in writing within ten (10) days of discovering any defect or deficiency.

The Contractor must be given reasonable access to the property to inspect and perform any necessary repairs.

Failure to provide access or written notice may void this guarantee.

EXCLUSIONS

This guarantee does not cover the following:

• Normal wear and tear.

• Damage caused by misuse, neglect, abuse, or improper maintenance.

• Damage caused by third parties, including other contractors or trades.

• Alterations, modifications, or repairs made without the Contractor’s written approval.

• Damage caused by structural movement, settlement, or defects in the existing building structure.

• Damage resulting from natural events such as storms, flooding, lightning, earthquakes, or other acts of nature.

• Materials supplied by manufacturers that are covered under separate manufacturer warranties.

LIMITATION OF LIABILITY

This guarantee covers workmanship only and does not extend to incidental, indirect, or consequential damages, including damage to building contents or personal property.

The Contractor’s responsibility under this guarantee is limited to the repair or replacement of defective workmanship only.

TRANSFERABILITY

This guarantee is not transferable unless approved in writing by the Contractor.

ENTIRE AGREEMENT

This guarantee represents the entire workmanship guarantee provided by the Contractor and replaces any other oral or written statements regarding workmanship.

No modifications to this guarantee shall be valid unless made in writing and signed by both parties.
