ROOF WORKMANSHIP WARRANTY

This Roof Workmanship Warranty is provided by Peachey Contracting (the “Contractor”), hereafter referred to as the “Warrantor.”

The Warrantor guarantees that the installation of the IKO roofing system has been completed in a professional and workmanlike manner. The Warrantor agrees to repair defects in workmanship for a period of five (5) years, commencing on the date of project completion.

During this warranty period, the Warrantor will repair any defects resulting from improper installation of the roofing system. This includes repair of the affected roofing components and any interior damage directly caused by installation-related defects.

Warranty repairs will be carried out within a reasonable time after receiving notice from the property owner and will be performed during normal working hours where reasonably possible.

CONDITIONS

1. The property owner must notify the Warrantor of any leak, defect, failure, or deficiency within ten (10) days of discovery.

2. Upon notification, the Warrantor has the right to inspect the roof and determine whether the issue is covered under this warranty.

3. If the issue is determined to be covered under this warranty, the Warrantor will perform the necessary repairs at no cost to the owner.

4. If the issue is determined not to be covered, the Warrantor may perform the repairs with the owner's written authorization, and all associated costs shall be the sole responsibility of the owner.

5. The Warrantor reserves the right to inspect the roof annually during the warranty period.

6. Full payment according to the contract terms constitutes the sole consideration for this warranty. Failure by the owner to make payment in accordance with the contract will void this warranty.

EXCLUSIONS

This warranty does not cover damage or defects resulting from the following:

1. Damage caused by fire, structural settling, structural failure, building distortion, or movement of the building structure.

2. Natural events or acts of God, including but not limited to floods, lightning, high winds, hail, hurricanes, tornadoes, earthquakes, or other extraordinary weather events.

3. Damage resulting from cracks or openings in the roof substrate, walls, foundations, or other structural components of the building.

4. Vandalism, abuse, third-party work, penetrations, or damage caused by foreign objects, equipment, plant growth, animals, or insects.

5. Damage resulting from modifications, alterations, additions, or structures installed on the roof, or from use of the roof for purposes other than its original intended design.

6. Damage caused by snow removal, heat cables, salts, chemicals, or similar materials or activities.

7. Any change in building use that affects the roof system without the Warrantor’s prior written approval.

8. Defects in roofing materials supplied by the manufacturer. Any material warranties are provided solely by the manufacturer.

The Warrantor shall not be liable for incidental, special, or consequential damages, including damage to building contents or personal injury resulting from defects in materials supplied by the manufacturer.

OTHER PROVISIONS

1. Modifications
   No modification of this warranty shall be valid unless made in writing and signed by all parties.

2. Transferability
   This warranty may be transferred to a new property owner, provided the Warrantor is notified within thirty (30) days of the property transfer.

3. Exclusive Warranty
   This warranty represents the sole and exclusive liability of the Warrantor regarding the roofing installation and any related repairs.

4. Disclaimer of Other Warranties
   This warranty is in lieu of all other warranties, whether written, oral, expressed, or implied, including any implied warranty of merchantability or fitness for a particular purpose.

5. Authorization
   This warranty is valid only when signed by an authorized representative of Peachey Contracting.

6. Owner Maintenance Responsibility
   This warranty does not replace the owner’s responsibility to maintain the roof. Excessive foot traffic, lack of maintenance, or damage caused by other contractors or trades may void warranty coverage.
